Free Spirited Insiders Membership Terms

These terms explain how the Free Spirited Insiders membership works, including the 21-day free trial, monthly billing, member benefits, and cancellation options. Please review them before choosing Insider Pricing and placing your order.
1. Choosing Insider Pricing or Full Price
Every eligible product can be purchased in one of two ways:
- Insider Pricing: You receive our lowest eligible product prices and your order includes enrollment in Free Spirited Insiders. Your membership begins with a 21-day free trial and then renews for $24.95 per month, plus applicable taxes, until canceled.
- Full Price: You pay the Full Price shown in your cart and complete a standard Shopify checkout. Full Price purchases do not include a membership, free trial, or recurring membership charge.
You can select Insider Pricing or Full Price in the cart drawer before checkout. Choosing Full Price does not enroll you in Free Spirited Insiders.
2. Free Trial and Automatic Renewal
When you choose Insider Pricing and affirmatively accept the membership and billing terms at checkout, your 21-day free trial begins on the date of enrollment. You pay $0 for the membership on the day you join.
Unless you cancel before the trial ends, your payment method will be charged $24.95, plus applicable taxes, on or about the 21st day after enrollment. The membership will then automatically renew every month at $24.95, plus applicable taxes, until you cancel.
Your checkout, order confirmation, and membership account provide the details associated with your enrollment. By accepting these terms at checkout, you authorize Free Spirited to charge your payment method for the recurring membership fee until cancellation.
3. Member Benefits
Active members may receive benefits that include:
- Access to Insider Pricing on eligible products.
- A $30 monthly Insider credit, subject to the redemption and expiration details shown in the member portal.
- Early access to new products, limited-edition designs, member voting, and exclusive promotions.
- Priority member support and other benefits described on the site or in the member portal.
After joining, retrieve your free U.S. shipping code from the member portal for future eligible orders.
Benefits, eligible products, and promotional availability may change. Credits and benefits have no cash value and may not be transferred unless Free Spirited expressly states otherwise.
4. Promotional Discounts
Unless a specific offer states otherwise, sitewide promotional discounts—including the current 15% offer—may be used with either an Insider Pricing cart or a Full Price cart. Each promotion remains subject to its stated eligibility, expiration date, exclusions, and combination rules.
5. Cancel Anytime
You may cancel at any time, including during the free trial. There is no seven-day advance-cancellation requirement. To prevent the next membership charge, complete your cancellation before that charge is processed.
The fastest online option is to log in and cancel through the membership portal. You may also request cancellation by emailing support@shopfreespirited.com or calling 252-597-9371.
Cancellation stops future recurring membership charges. Membership access and unused member benefits end when cancellation is completed unless your account or applicable law provides otherwise.
6. Billing Questions and Refunds
If you did not intend to enroll, were confused about a membership charge, or believe a charge was made in error, contact us promptly. At your request, we will cancel the membership and review the charge so we can make it right, including a refund when appropriate. Nothing in these terms limits any refund or cancellation right provided by applicable law.
Returns and refunds for merchandise purchases are governed separately by our Refund Policy.
7. Renewal Notices and Account Information
We will send enrollment confirmations and any trial or renewal notices required by applicable law. You are responsible for keeping your email address and payment information current and for reviewing messages relating to your membership.
8. Failed Payments
If a payment fails, we may retry the payment and notify you. We may suspend or cancel membership benefits if payment remains unsuccessful. You remain responsible for valid unpaid membership charges incurred before cancellation, subject to applicable law.
9. Price or Membership Changes
We may change the membership price or benefits. When advance notice is required, we will notify you before the change takes effect. You may cancel before a new price applies. Material changes will not reduce rights already provided under applicable law.
10. Termination by Free Spirited
We may suspend or terminate a membership for fraud, abuse, nonpayment, violation of these terms, or unlawful activity. When permitted and appropriate, we will provide notice. Termination does not limit rights or remedies available under applicable law.
11. Disclaimer of Warranties
To the fullest extent permitted by law, the membership and its benefits are provided on an “as is” and “as available” basis. Free Spirited does not make warranties beyond those expressly stated on the site or required by law. These terms do not exclude warranties or consumer protections that cannot legally be excluded.
12. Limitation of Liability
To the fullest extent permitted by law, Free Spirited will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the membership. This limitation does not apply where prohibited by law or to liability that cannot legally be limited.
13. Dispute Resolution and Arbitration
Except for claims eligible for small claims court or where prohibited by law, disputes arising from these membership terms or the membership will be resolved through individual binding arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules. The Federal Arbitration Act governs this arbitration agreement.
Arbitration may take place remotely or in Fort Lauderdale, Florida, as permitted by the applicable rules and law. The arbitrator may award any relief available under applicable law. Nothing in this section prevents either party from seeking appropriate relief for intellectual-property misuse or other relief that cannot legally be restricted to arbitration.
14. Class Action and Jury-Trial Waiver
To the fullest extent permitted by law, disputes will be handled only on an individual basis and not as part of a class, consolidated, or representative action. If a dispute proceeds in court, each party waives a jury trial to the extent permitted by law.
15. Governing Law and Severability
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where the law of your state or country must apply. If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.
16. Entire Agreement and No Waiver
These terms, the membership disclosures presented at checkout, and any policies expressly incorporated here form the agreement governing Free Spirited Insiders. A failure to enforce a provision does not waive the right to enforce it later.
